The Court of Appeal, sitting in Ibadan, Oyo State capital on Monday reinstated Ladi Adebutu as the governorship candidate of the Peoples Democratic Party (PDP) in Ogun State.
The appellate court in its ruling also reinstated others candidates of the party in Ogun State.
News360 info gathered that the Court of Appeal set aside the ruling of the Federal High Court, sitting in Abeokuta, which nullified the primaries of the PDP.
Recall that Justice O. Oguntoyinbo of the Federal High Court had nullified the candidacy of Adebutu and other candidates of PDP in Ogun State.
The ruling was passed by the judge following a suit filed by Segun Seriki and others.
However, Justice Folasade Ojo on Monday ruled that only the National Working Committee (NWC) of the PDP has the power to nominate and conduct a primary election.
The court ruled that any primary held without the approval of the party’s NWC is null and void.
The earlier ruling of the Federal High Court was set aside for lack of jurisdiction.
Justice Ojo directed the Independent National Electoral Commission (INEC) to reinstate all PDP candidates.
Adebutu would be hoping to contest against the state Governor and governorship candidate of the All Progressives Congress, Dapo Abiodun in 2023.
