Niger State: Court order restrains NLC, TUC from strike

The Niger State Government has secured an order of interim injunction restraining the Nigerian Labour Congress and the Trade Union Congress from calling out civil and public servants in Niger State on strike action pending the determination of the motion on notice, which is fixed for July 15, 2016.

This followed the failure to reach consensus by the state government and Organised Labour on the payment of full salaries.

In a statement jointly signed by the Chairman of the NLC, Idris Yahaya Ndako, and the Chairman of the TUC, Comrade Yunusa Tanimu, the organised labour called on all Civil servants in the state to embark on an indefinite strike until the state government rescinds its decision.

However, in a swift response, the Niger State Commissioner for Information, Culture and Tourism, Comrade Jonathan Tsado Vatsa, said in a statement made available to The Eagle Online that the Expertise Order was granted by Hon. Justice P. O. Lifu of the National Industrial Court of Nigeria in Abuja.
This was after considering Suit No:NICN/ABJ/259/2016.

Also joined in the expert order are the Incorporated Trustees of both the NLC and TUC in Niger State.

According to Lifu: “The Judge’s decision was premised on the provision of section 254, paragraph k of the 1999 Constitution as amended which gives the Court exclusive powers on issues bordering on dispute arising from payment or non-payment of salaries of any employee.

“By this order granted Niger State Government, the strike action planned for civil and public servants in Niger State has become null and void and indeed of no effects.”

Vatsa, therefore, warned: “All civil and public servants in Niger State are strongly advised to report to work and go about their normal businesses in their respective offices without fear of molestation or intimidation by any individual or group of individuals in what ever cover.
“Any civil and public servants found circumventing this Court Order will have him or herself to blame.”
